These terms are the contract
These Terms of Service are the contract for using CrewGlance. The provider is the operator of CrewGlance at crewglance.com.
By creating a workspace, starting checkout, installing the agent, or clicking to accept, the customer agrees to these terms and to the Privacy Policy. If you do not agree, do not use CrewGlance.
A lawyer should review these terms before you rely on them. They are a plain-English starting contract for CrewGlance, not a law-firm opinion and not legal, medical, or financial advice.
The service
CrewGlance is workplace activity-monitoring software. A customer installs a Windows agent on computers used by its workforce. The agent records the foreground application, window title, idle time, lock, sleep, and logon events, and periodic screenshots. It can also report the computer's Tailscale name and address so an admin can open a remote-desktop file.
The dashboard shows that activity to people the customer authorizes. Categories such as productive, unproductive, and idle follow rules the customer sets. Optional alerts can text or email through an Amazon SNS topic the customer configures. CrewGlance does not give medical, legal, employment, or financial advice, and a category is not a judgment of a person's worth or health.
Who may agree
The person who accepts must be authorized to bind the employer or other organization that will use the workspace. That organization is the customer. The workspace, the logins, and the activity data belong to that customer.
I am authorized by the employer or organization to agree to these terms. The organization will give employees any notice the law requires, and will get any consent the law requires, before the monitoring agent is installed or activity data is collected. The organization will use CrewGlance only for lawful workplace purposes.
Acceptable use
Use CrewGlance only for lawful workplace monitoring of the customer's own workforce, on computers the customer is allowed to monitor. Do not use it to commit a crime, to harass someone, to sell personal data, or to watch people who are not the customer's workforce.
Do not attempt to open another customer's workspace, probe the service for a way around the login, or interfere with other customers. Do not use the agent on a computer the organization does not own or control unless the person using that computer has agreed.
Customer responsibilities
The customer decides which people are monitored and for what workplace purpose. Before the agent is installed or activity data is collected, the customer will give any notice the law requires and will get any consent the law requires. The customer will tell people that monitoring is on.
The agent can show a short on-screen notice that monitoring is running, and a message before certain remote commands. That on-screen notice does not replace the customer's own legal duties.
The customer keeps login passwords and agent keys safe, and installs the agent only after the duties in this section are met. The customer is responsible for how it uses activity reports, alerts, and screenshots, including any employment decision it makes.
Fees
Paid plans are billed by Stripe at the prices shown at checkout. CrewGlance does not store the card number. The operator's own workspace may be billed outside Stripe. Fees are for access to the service. Taxes may be added where required. If a subscription is unpaid, access to activity can be suspended until it is current.
Disclaimer of warranties
CrewGlance is provided as is and as available. The operator disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the service will be uninterrupted, error-free, or lawful for a particular workplace. The customer is responsible for deciding whether monitoring is allowed where its people work.
Activity categories, idle time, and screenshots can be incomplete or wrong. They are not a guarantee of what a person did, and they are not legal, medical, or financial advice.
Limitation of liability
To the fullest extent the law allows, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or employment disputes, even if advised they were possible.
The operator's total liability for a claim arising out of the service is limited to the fees the customer paid for CrewGlance in the three months before the claim, or one hundred U.S. dollars if the customer paid nothing. Some jurisdictions do not allow these limits. In those places, the limits apply only as far as the law allows.
Indemnification
The customer will indemnify and hold harmless the operator of CrewGlance from claims, damages, and reasonable expenses arising out of the customer's use of the service, the customer's activity data, a failure to give required notice or get required consent, or a use that breaks these terms or the law. The operator will give the customer prompt notice of a claim it expects the customer to cover, where the law requires that notice.
Termination
The customer may stop a paid subscription in the billing portal. The operator may suspend or end access if the customer does not pay, breaks these terms, or uses the service unlawfully. When access ends, the customer stops using the agent and the dashboard. The Privacy Policy describes how workspace data is kept. Sections that should survive, including warranties, liability, indemnification, and governing law, stay in effect.
Governing law and venue
Texas law governs these terms, without regard to conflict-of-law rules. The state and federal courts located in Harris County, Texas are the exclusive venue for a dispute about these terms or CrewGlance, and each party consents to personal jurisdiction there. The operator is in the Houston area. Either party may still seek a temporary restraining order for misuse of the service or of data.
Changes
The operator may update these terms or the Privacy Policy by posting a new version at the same address. The version date on the page is the date stored when you accept. If the documents change, an existing workspace is asked to accept the new version the next time someone signs in to the dashboard. Continuing to use CrewGlance after that acceptance is agreement to the updated contract. If you do not agree to an update, stop using the service.
